Moss Nook Terms of Use

This English text is provided for convenience only; the Japanese version is authoritative and governs in case of any discrepancy. These Terms of Use (the "Terms") set out the conditions for using the smartphone app "Moss Nook" (the "App") provided by Liyuu (the "Developer"). By downloading or using the App, you are deemed to have agreed to these Terms.

2. Intellectual Property

All copyrights, trademarks, and other intellectual property rights relating to the App belong to the Developer or to third parties holding the relevant rights. These Terms grant only a license to use the App and do not transfer any intellectual property rights. Creations you make within the App (terrarium layouts, etc.) remain yours to keep, but the rights to the 3D models, textures, and other assets used to create them (moss, bases, props, etc.) remain with the Developer or the relevant third-party rights holder.

3. In-App Purchases

The App offers one-time in-app purchases for theme packs (exclusive props, bases, moss, and colors) and an ad-removal feature. Purchases are processed through the Apple App Store or Google Play, and payment and refunds are governed by the terms and policies of the respective platform. The Developer is not responsible for issues arising from a purchase beyond what is required by the platform. If you lose access to a theme pack, any exclusive content already placed in your saved creations remains visible and editable, but placing or applying it again requires purchasing it once more.

4. Disclaimer

The Developer does not warrant that the App is free of defects, whether factual or legal, including with respect to safety, reliability, accuracy, completeness, effectiveness, fitness for a particular purpose, the absence of bugs or errors, or the absence of rights infringement. Except in cases of the Developer's intentional misconduct or gross negligence, the Developer is not liable for any damages arising from your use of the App.

5. Changes to or Discontinuation of the App

The Developer may change the content of the App, or suspend or discontinue it, without prior notice to users. The Developer is not liable for any damages arising from such changes, suspension, or discontinuation.

6. Governing Law and Jurisdiction

These Terms are governed by the laws of Japan. Any dispute arising in connection with the App shall be subject to the exclusive jurisdiction of the court having jurisdiction over the location of the Developer as the court of first instance.
